PulseMarketing HQ ("PulseMarketing", "we", "us") is operated by Vintage Rust LLC, a Florida limited liability company. By using our service, you agree to these terms. Plain language, no fluff.
PulseMarketing HQ is software-as-a-service that automates social media posting for small businesses. You connect your Facebook page (and optionally Instagram) through OAuth, and our AI generates and publishes content to your accounts on a schedule you control.
We are software, not marketing advice. We don't guarantee results. We don't guarantee growth. We don't guarantee that posts will always publish (third-party APIs can fail). We give you tools — outcomes depend on your business, audience, and market.
You must be 18 or older and represent a real business to use PulseMarketing HQ. You're responsible for keeping your login credentials secure. You're responsible for everything posted from your connected accounts using our service.
One person per account unless you've contacted us about team access. Don't share login credentials with people outside your business.
When you connect your Facebook page through our OAuth flow, you authorize us to post on your behalf using a Page Access Token issued by Meta. We never see or store your Facebook password.
You can revoke our access at any time through your Facebook Business Settings. Revoking access stops all posting immediately. See our Data Deletion page for details on removing your data entirely.
You're responsible for owning or having permission to post from any account you connect. If you don't own it, don't connect it.
Our AI generates content based on the brand profile we build from your business information, website, and social presence. You can review this profile in your dashboard and edit any field at any time.
Generated content is published to your accounts under your brand identity. You are responsible for the content posted from your accounts, including AI-generated content. We provide tools to control this:
If you see content you didn't approve, contact us immediately at hello@pulsemarketinghq.com.
Subscriptions are billed monthly through Square. We don't see your card number — Square holds it. We see only the customer ID and subscription ID needed to manage your billing.
Pricing tiers as published on our pricing page. We may change pricing for new signups; existing subscribers will be notified by email at least 30 days before any price change takes effect on their account.
Cancel any time from your dashboard or by emailing hello@pulsemarketinghq.com. Cancellations take effect at the end of the current billing period. We don't pro-rate partial months. We don't issue refunds for unused time except where required by law.
If your payment fails, we'll notify you and attempt to retry. If we can't collect within 14 days, we'll pause your service. Service resumes when payment succeeds.
Don't use PulseMarketing HQ to:
If you do, we'll terminate your account without refund.
You own your content — your brand information, photos, copy, customer details. By using PulseMarketing HQ, you grant us a limited license to use your content solely to provide the service: generate posts, publish them to your connected accounts, and improve our AI's understanding of your brand.
We don't sell your content. We don't share it with other clients. We don't use it to train public AI models.
When you delete your account, your content is removed per our Data Deletion policy.
We aim for high availability but don't guarantee uninterrupted service. Things that can affect posting:

We comply with applicable data protection laws including the California Consumer Privacy Act (CCPA). If you have data requests, email hello@pulsemarketinghq.com.
In the unlikely event of a data breach affecting your account, we will notify you within 30 days of confirmation per our breach response policy.
PulseMarketing HQ is provided "as is" without warranties of any kind, express or implied. We don't warrant that:
You use the service at your own risk and are responsible for evaluating whether it fits your business.
To the maximum extent allowed by law, our total liability for any claim arising from your use of PulseMarketing HQ is limited to the amount you paid us in the one (1) month immediately before the claim arose.
We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost data, or business interruption — even if we knew such damages were possible.
Some jurisdictions don't allow these limitations. In those jurisdictions, our liability is limited to the smallest amount allowed by law.
You agree to indemnify and hold harmless PulseMarketing HQ, Vintage Rust LLC, and our operators from any claim, loss, or expense arising from:
Either of us can terminate your account at any time. You can cancel from your dashboard or by emailing us. We can terminate for breach of these Terms, non-payment, or any reason with 30 days written notice.
On termination:
These Terms are governed by Florida law, without regard to conflict-of-law principles.
Any dispute arising from these Terms or your use of PulseMarketing HQ will be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Arbitration will take place in Polk County, Florida unless we agree otherwise.
You waive the right to a jury trial and the right to participate in class actions or class arbitrations.
Either party may bring small-claims actions in the appropriate Florida small-claims court.
We may update these Terms occasionally. If we make material changes, we'll email active subscribers at least 30 days before the changes take effect. Continued use after the effective date means you accept the updated Terms.
